Agreement to Terms
By accessing or using the digital environments and professional services of Kachaam Design Studio ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement concerning your access to and use of our website and services. If you do not agree to these structural standards, we respectfully ask that you do not engage our services or use our platform.
Services Description
Kachaam Design Studio provides high-fidelity UX/UI design, brand identity systems, and digital product strategy services. The specific scope, design deliverables, timeline, and investment for each project will be rigorously outlined in a separate Statement of Work (SOW) or Master Service Agreement (MSA) signed by both parties.
Intellectual Property
3.1 Client Materials
You retain all inherent rights to any materials provided to us for use in the project, including existing brand assets, proprietary data, and content.
3.2 Our Work
Upon full fulfillment of all financial obligations, ownership of the final design deliverables will be transferred to you as specified in your agreement. Kachaam retains the right to display the work in our portfolio and marketing materials as a testament to our design legacy, unless a specific Non-Disclosure Agreement (NDA) dictates otherwise.
3.3 Preliminary Work
All conceptual drafts, preliminary sketches, and design variations not selected for the final deliverable remain the exclusive property of Kachaam Design Studio.
Payment Terms
- Payment terms are defined within the Project Agreement.
- We typically require a 50% initial investment to secure the project timeline and initiate research.
- Final balances are due upon milestone completion or as specified in the agreed payment schedule.
- Late payments may incur a service charge of 1.5% per month to account for administrative overhead.
- All professional fees are non-refundable once work has commenced.
Project Timeline & Momentum
Timelines are strategic estimates based on the scope defined in our agreement. Delays in feedback, content delivery, or significant scope adjustments will naturally extend the project timeline. We maintain transparent communication regarding all timeline shifts to ensure project momentum.
Revisions & Refinement
The number of refinement rounds is clearly specified in your agreement. Additional iterations beyond the agreed scope may be subject to additional fees to ensure the integrity of the studio's resource allocation. Final approval at each structural stage is required before proceeding to subsequent phases.
Confidentiality
Both parties agree to maintain the absolute confidentiality of proprietary information shared during the engagement. This includes business strategies, technical specifications, and sensitive customer data.
Limitation of Liability
To the maximum extent permitted by law, Kachaam Design Studio shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific project giving rise to such liability.
Termination
Either party may terminate the engagement with written notice. Upon termination, the client will be invoiced for all work completed to date. Initial deposits remain non-refundable as they cover preliminary research and resource allocation.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be resolved exclusively within the courts of New Delhi, India.
